The EACC Aims to Reclaim Land Valued at Sh1.6 billion from Private Owners


The Ethics and Anti-Corruption Commission (EACC) is currently prosecuting four legal cases against private companies and former Commissioners of Land, aiming to reclaim five plots of land situated in Nairobi's Central Business District (CBD).

These properties, estimated to be worth over Sh1.6 billion, are purportedly seized from the Kenya Railways Corporation (KRC) and the Nairobi City Council (NCC).

Defendants in these lawsuits include Apostle James Maina Ng’ang’a of Neno Evangelism Center, Rubis Energy (formerly Kobil Petroleum), Arts 680 Limited, and Lima Limited.

The EACC alleges that the land was unlawfully assigned or transferred to the defendants without adhering to proper procedures. The commission has stated its intention to nullify the titles and return ownership to the appropriate public entities.

Furthermore, the commission is requesting mesne profits amounting to Sh1.6 billion from the defendants for the unauthorized utilization of the land.

One of the disputed plots is LR. No. 209/12492, covering an area of 0.2593 hectares and appraised at Sh380 million.

This land was initially a portion of a larger parcel that the Kenya Railways Corporation (KRC) relinquished to the government in 1953 and 1960 for the development of the Post and Telecommunication Headquarters and a flyover.

The EACC contends that Arts 680 Limited received the land in question irregularly in 1994 from the Commissioner of Lands at that time. Another plot, LR. No. 209/9640, covering 0.2766 hectares and valued at Sh480 million, is presently owned by Neno Evangelism Center Registered Trustees, under the leadership of Apostle James Maina Ng’ang’a. This plot, too, was part of the land surrendered by KRC to the government in 1953 for the Post and Telecommunication Headquarters. The EACC alleges fraudulent transfer to Neno Evangelism Center by the former Commissioner of Lands.

Additionally, LR. No. 209/12361, measuring 0.0253 hectares and valued at Sh30 million, is owned by Apostle James Maina Ng’ang’a, who also owns Neno Evangelism Center. This parcel, too, was part of the land surrendered by KRC in 1960 for a flyover, and the EACC alleges illegal allocation by the former Commissioner of Lands.

The last two parcels, LR. No. 209/9641 and LR. No. 209/12133, measuring 0.2766 hectares and 0.14 hectares respectively, with values of Sh480 million and Sh240 million respectively, are owned by Rubis Energy (formerly Kobil Petroleum). 

These plots were part of the land surrendered by KRC for the Post and Telecommunication Headquarters. LR. No. 209/12133 was also carved out of a public road reserve, containing a public toilet owned by NCC. The EACC alleges unlawful transfer to Rubis Energy by the former Commissioners of Lands.

The EACC has submitted witness statements and documents to bolster its assertions and has requested the consolidation of the cases to streamline proceedings and prevent duplication.
